General Terms and Conditions (GTC) of CSR-Report.net
§1 Scope and Definitions
(1) These General Terms and Conditions (hereinafter referred to as “GTC”) govern the contractual relationship between CSR-Report.net (hereinafter referred to as “Operator”) and natural or legal persons (hereinafter referred to as “Submitter”) who use the internet platform CSR-Report.net (hereinafter referred to as “Platform”) to submit and publish CSR reports (hereinafter referred to as “Reports”).
(2) Deviating conditions of the Submitter are not recognized unless the Operator expressly agrees to their validity in writing.
§2 Service Description
(1) The platform serves as an index for CSR reports from various companies. Submitters have the opportunity to submit their reports for publication on the platform, subject to a processing fee.
(2) The submission, review, and publication of reports are subject to the quality criteria and guidelines of the Operator.
§4 Submission and Review of Reports
(1) By submitting a report for publication on the platform, the Submitter agrees to pay the processing fee if the report is published on the platform after review by the Operator.
(2) The Operator reserves the right to reject submitted reports without providing reasons or to request changes necessary for publication.
§5 Payment Conditions
(1) The processing fee for submitting a report is €100, including taxes. This fee is charged exclusively by invoice.
(2) Invoices are issued by Pfahler & Bauer GmbH, located at Werner-von-Siemensstr. 2-6, Building 5112, 76646 Bruchsal, Germany, with VAT ID DE362260245. Invoices will be sent electronically to the email address provided by the Submitter and are payable within 14 days from the invoice date without deduction.
(3) In case of late payment, the Operator reserves the right to charge statutory interest on arrears and withhold the publication of the report until full payment is received.
§6 Limitation of Liability and Indemnification
(1) The Operator is not liable for the accuracy, completeness, or timeliness of the published reports. Liability for intent and gross negligence remains unaffected.
(2) The Submitter indemnifies the Operator from all claims by third parties arising from the infringement of their rights due to the publication of the reports.
§7 Modification of the GTC
(1) The Operator reserves the right to change these GTC at any time with future effect. The Submitter will be informed of significant changes by email. If the Submitter does not object to the amended terms within four weeks of receiving the notification, the amended GTC are deemed accepted.
§8 Final Provisions
(1) The contractual relationship between the Operator and the Submitter is subject to the law of the country in which the Operator is based.
(2) Should any provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
These expanded GTC take into account specific elements such as payment terms and liability limitations. They are intended as a basis but need to be adapted to individual needs and legal requirements and reviewed by a legal advisor.
